1. Definitions

For the purposes of these Terms and Conditions:

  • "Bespoke / Custom Order" refers to any Goods made-to-measure or specially crafted to your individual specifications.
  • "Made-to-Order" refers to Goods produced in a standard size upon receipt of your order, as distinct from a fully bespoke garment.
  • "Device" means any device capable of accessing the Website, including computers, mobile phones, and tablets.


2. Acknowledgment

These Terms and Conditions form the entire agreement between You and the Company with respect to your use of the Website and the Service. By accessing the Website or placing an order, you confirm that:

  • You are at least 18 years of age, or if a minor, you have received explicit parental or guardian consent to use the Service;
  • You have the legal capacity to enter into a binding agreement;
  • All information you provide to us is accurate, current, and complete;
  • You will not access the Website through automated means (bots, scripts, or otherwise);
  • You will not use the Website for any unlawful or unauthorized purpose.


The Website is intended for users who are at least 13 years of age. Users who are minors in their jurisdiction must have parental permission to use the Website. If you provide any information that is untrue, inaccurate, or incomplete, we reserve the right to refuse any current or future use of the Service.


3. Direct Orders

We offer virtual consultations and direct orders for customers who do not have a Serge Jevaguine retailer in their area. Through a virtual consultation, our team will guide you through fabric selections, silhouette options, measurements, and all customization details — from anywhere in the world.

4. Bespoke & Custom Orders

Serge Jevaguine specializes in bespoke and made-to-measure couture. Bespoke and custom orders are subject to the following additional terms:

4.1 Order Process

Custom orders are initiated through a private consultation (in-person or virtual). A detailed design brief, measurements, and fabric selections will be confirmed in writing before production begins. No custom order commences until both parties have confirmed all specifications and a deposit has been received.

4.2 Deposit & Payment

A non-refundable deposit of 50% of the total order value is required to initiate production of any bespoke or custom garment. The remaining balance is due prior to delivery or collection of the finished garment.

4.3 Non-Cancellation & Non-Refund Policy for Custom & Made-to-Order

All ready-to-wear and made-to-order styles are Final Sale and are not eligible for return or exchange. Because bespoke and custom-made garments are created exclusively for each individual client using materials sourced and cut specifically for that order, all custom and made-to-order orders are final once production has commenced. This does not affect your statutory rights under applicable Canadian consumer protection law.

4.4 Timeline

Estimated production timelines will be provided at the time of order confirmation. These are estimates only and may be subject to variation due to fabric sourcing, artisan availability, or other circumstances beyond our control. We will communicate any significant delays promptly.


5. Alterations

Your gown will be ordered in a US gown size, whether you place your order through one of our authorized Retailers or directly through our Website. Sizing is based on the measurements you provide at the time of ordering.

Should you require any adjustments to your gown after delivery, all authorized boutiques through whom you purchased your gown are able to assist you with alteration services. Alterations are also available at our Atelier in Toronto, Canada.

6. Ready-to-Wear & Online Purchases

6.1 Product Descriptions

We make every effort to display our Goods as accurately as possible, including colours, fabrics, embellishments, and dimensions. However, colours displayed on your device may not accurately reflect the true appearance of the garment due to variations in screen calibration. All Goods are subject to availability.

6.2 Placing an Order

All product listings on the Website constitute an invitation to purchase, not a contractual offer. A purchase contract is formed only when your order has been confirmed and accepted by us, and you have received an electronic order confirmation.

6.3 Pricing

All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change without notice. Applicable taxes and shipping costs will be calculated and displayed at checkout.


7. Return & Exchange Policy

7.1 Final Sale Items

All ready-to-wear and made-to-order styles are Final Sale and are not eligible for return or exchange. Sale merchandise is final sale with no exceptions. International orders are final sale and cannot be returned.


7.2 General Return Policy

Serge Jevaguine wants to ensure your complete satisfaction with all online purchases. We will gladly accept returns of unworn or unaltered merchandise within 10 calendar days from the date delivered, subject to the conditions below.

To begin a return, send us an email to info@sergejevaguine.com within 10 calendar days of delivery. Returns initiated after this window will not be accepted.

Returned merchandise must:

  • Include all original tags, packaging, and accessories;
  • Be unworn, unaltered, and in the same condition as received;
  • Be packaged in a suitable manner to protect the contents during transit.


Serge Jevaguine reserves the right to refuse the return of any merchandise that does not adhere to our policy. Non-compliant items will not be accepted and will be returned to the customer at their expense.


7.3 Restocking Fee

All eligible categories may be returned for a refund less a $150 CAD restocking fee, or exchanged for another item. The restocking fee will be deducted from your refund at the time of processing.


7.4 Shipping & Duties

All duties, taxes, and original shipping fees are non-refundable. Return shipping costs are the responsibility of the customer. All exchanges and replacement shipments will be processed and shipped once your original item has been received and approved by our team.


7.5 Damages & Incorrect Items

Please inspect your order immediately upon reception. If your item is defective, damaged, or incorrect, contact us immediately upon delivery so that we can evaluate the issue and make it right:

Do not attempt to return a damaged or incorrect item without first contacting us. We will provide return instructions on a case-by-case basis.


7.6 Exchanges

The fastest way to ensure you receive the item you want is to return the eligible item in accordance with our return policy, and once the return is received and approved, make a separate purchase for the new item. All exchanges will be shipped once your original item has been received and approved.


7.7 Refunds

Upon receipt of your returned merchandise, we will inspect it and notify you by email whether your refund has been approved. If approved, your refund will be issued to your original payment method, less the $150 restocking fee and any applicable non-refundable shipping or duty costs. Please allow additional time for your bank or credit card company to process and post the refund to your account.

Refunds may only be issued in the same form as the original payment.


8. Intellectual Property Rights

All content on the Website — including photographs, illustrations, videos, design sketches, collection names, lookbooks, text, code, and the overall look and feel of the Website — is the exclusive property of Serge Jevaguine and is protected by Canadian and international copyright, trademark, and intellectual property laws.

You may view content on the Website for personal, non-commercial purposes only. You may not download, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission.

The SERGE JEVAGUINE name, logo, and all collection names are trademarks of the Company. Unauthorized use of our trademarks is strictly prohibited.

Any breach of these intellectual property rights constitutes a material breach of these Terms, and your right to use our Website and Service will terminate immediately.


9. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability to you for any claim arising out of or related to these Terms or the Service shall be limited to the amount actually paid by you for the specific Goods giving rise to the claim.

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business, even if we have been advised of the possibility of such damages.

We do not guarantee that the Website will be available at all times, error-free, or free from viruses or other harmful components.

Nothing in these Terms limits liability that cannot be excluded under applicable Canadian consumer protection law, including the Consumer Protection Act (Ontario) and the Sale of Goods Act (Ontario).

The Website may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. 11. Customer Conduct & Reviews

You agree not to engage in any activity that disrupts or interferes with the Website. This includes hacking, distributing malware, or any form of unauthorized or illegal activity.

If you submit a review or testimonial on the Website, you agree to:
